Attorney Questions 'Police Source' Leaks in Bashara Case

A Grosse Pointe attorney and former public safety officer from Grosse Pointe Park questions the ever-evolving release of information to the media related to the homicide investigation of Jane Bashara.

The investigation of began last week after behind a vacant house in Detroit near 7 Mile and Hoover roads.

The strangulation death of a woman who was received the typical media attention. At first, it appeared on the local television news programs and was written up in the Detroit newspapers.

Then, the media attention intensified, . A dozen or so cameras on tripods as they exited Grosse Pointe Memorial and about as many lined up outside of the Bashara home Wednesday.

Attorney and retired Lt. Randall Cain, who also lives in the Grosse Pointes and works at in the Farms, said Thursday he questions the seemingly unending leak of information from unamed police sources. He believes the leaks, at the very least the sheer number of leaks, could ultimately hurt the case should it ever go to court, he said.

"The big thing that has struck me is the unnamed police sources," Cain said. "It's more than I think there should be." He noted how every newscast there seems to be a new twist to the case, which is likely broadening the area of investigation for police.

"It's hard to keep track of all the players," he said. "I think the police have their hands full with this (case)."

All of the leaks could become ammunition for a defense attorney and make prosecution more difficult, Cain said.

He understands the interest within the Grosse Pointes about the case, and even in the metro area because the community, he said, is "thankfully" not plagued by such violent crimes. But Cain said he does not know why it has garnered national and even international attention.

"It's an intriguing homicide," he said. "I think it's become an intriguing who done it?"

Similar to the news of Jane Bashara's violent, unexpected death, news of the most recent reports related to Bob Bashara's sexual preferences and the possibility of a "sex dungeon" have traveled throughout the community quickly. 

Many people have shared their disgust and surprise on social media sites.

Bob Bashara's sex life and the existance of a sex dungeon is likely part of the police investigation as to whether it may have led to Jane Bashara's death, Cain said, but as far as an investigation just of a sex dungeon by itself is unlikely. As long as nothing illegal was happening there, it is not against the law, he said.

"A lot of things go on that other people don't like," Cain said. "It may well just be a rumor. There is nothing concrete regarding (the existence of the sex dungeon)."

The thought behind not addressing it, Cain said, is that Bob Bashara is not participating in the case being tried in the media.

"Let the investigation prove it," Cain said of Bashara's choice to not express his innocence.

Should the case end up in court at some point, Cain said the heavy media coverage is likely to lead any defense attorney to request the trial be moved from Wayne County so as to find jurors who are not biased from their exposure to it.

"All I know," Cain said, "there is a lot of legal work to do."
